Lawnnova Terms Of Use

1. Legal Information

These Terms of Use ("Terms") govern your access to and use of the Lawnnova mobile application, web application, website, support channels and related services.

In these Terms, "Lawnnova", "we", "our" and "us" means the operator of the Lawnnova service.

2. Acceptance

By creating an account, accessing or using Lawnnova, you agree to these Terms and the Lawnnova Privacy Policy.

If you do not agree, you must not use the service.

3. The Service

Lawnnova provides lawn-care planning, scheduling, reminders, treatment tracking, product inventory support, weather-aware guidance, growing-degree-day guidance, address/location features, optional image analysis and optional AI chat.

Lawnnova is designed to help users organise and review lawn-care activity. It is not a substitute for professional agronomic, horticultural, environmental, legal, safety or chemical-use advice.

4. Eligibility

You must be legally capable of entering into a binding agreement and old enough to use online services in your location.

Lawnnova is not directed to children under 16 years of age.

5. Account Registration And Security

You are responsible for:

• providing accurate account information;
• maintaining the confidentiality of your login credentials;
• all activity that occurs under your account;
• promptly notifying us of suspected unauthorised access.

We may refuse, suspend or terminate accounts where we reasonably believe there has been misuse, fraud, security risk, breach of these Terms or unlawful conduct.

6. Lawn Profile, Product And Schedule Information

You are responsible for the accuracy of the lawn, property, product, inventory, treatment history and schedule information you enter or approve.

Lawnnova may generate schedule previews, warnings, follow-ups and reminders based on information available to the app. If that information is incomplete, inaccurate or outdated, generated outputs may also be incomplete, inaccurate or unsuitable.

You must review all schedule items before relying on them.

7. Lawn-Care And Product Disclaimer

Lawnnova provides informational and organisational guidance only.

Before applying any lawn-care product, fertiliser, herbicide, pesticide, fungicide, wetting agent, plant growth regulator or other treatment, you must:

• read and follow the product label and safety data sheet where applicable;
• confirm the product is suitable for your grass variety, lawn condition and location;
• comply with all laws, regulations and restrictions;
• consider weather, soil moisture, irrigation, temperature, wind, rainfall and site conditions;
• use appropriate personal protective equipment;
• keep people, children and pets away from treated areas as required by the product label.

Product labels, regulatory directions and manufacturer instructions always prevail over any information shown in Lawnnova.

To the maximum extent permitted by law, Lawnnova is not responsible for turf damage, plant injury, property damage, chemical misuse, regulatory breach, personal injury or financial loss arising from your use of lawn-care products or reliance on app guidance.

8. Weather, GDD And Location Disclaimer

Weather, temperature, rainfall, evapotranspiration and growing-degree-day information may be obtained from third-party providers. This information may be delayed, incomplete, unavailable or inaccurate.

You remain responsible for checking current local conditions before watering, mowing, spraying, fertilising or applying any treatment.

9. AI Features

AI features are optional and may include AI chat or image analysis.

AI outputs are advisory only. They may be inaccurate, incomplete, outdated, biased or unsuitable for your circumstances.

AI outputs must not be treated as professional agronomic, environmental, legal, safety or chemical-use advice.

You must not use AI features to upload or process unlawful, harmful, private, sensitive or third-party information unless you have the right to do so.

Lawnnova may limit, suspend or disable AI features for safety, cost, misuse, operational or legal reasons.

10. Image Uploads

If image upload or image analysis features are available, you are responsible for ensuring that any uploaded images are lawful and appropriate.

Do not upload images containing people, faces, addresses, number plates, private documents, children, sensitive information or content you do not want processed.

You grant Lawnnova a licence to store, transmit, analyse and process uploaded images only as reasonably required to provide the relevant feature, support the service, comply with law and enforce these Terms.

11. User Content

You retain ownership of content you submit to Lawnnova, including notes, custom product names, custom treatments, messages, feedback and images.

You grant Lawnnova a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, transmit, display and use your content solely for the purpose of operating, providing, securing, supporting and improving the service.

You represent that you have the rights needed to submit the content and grant this licence.

12. Subscriptions, Payments And App Stores

Some features may require payment or subscription.

Where purchases are made through Apple App Store, Google Play or another platform, payment, renewal, cancellation and refund terms may be governed by that platform's rules.

Unless otherwise required by law or platform rules:

• subscriptions renew automatically until cancelled;
• cancellation takes effect at the end of the current billing period;
• fees already paid are generally non-refundable;
• we may change pricing or features with notice where required.

You are responsible for managing subscriptions through the platform or payment provider used for purchase.

13. Trials, Beta Features And MVP Features

Lawnnova may offer free trials, beta features, experimental features, pre-release features or development/demo functionality.

These features may be incomplete, unstable, unavailable, changed, removed or reset without notice.

Do not rely on beta, development or demo features for critical lawn-care decisions.

14. Acceptable Use

You must not:

• use Lawnnova unlawfully or deceptively;
• interfere with security, authentication, access controls or service operation;
• attempt to reverse engineer, scrape, copy, overload or disrupt the service;
• upload malicious code or harmful content;
• use the service to infringe intellectual property or privacy rights;
• misuse AI, image analysis, support or automation features;
• attempt to access another user's account or data;
• resell, sublicense or commercially exploit the service without written permission.

15. Intellectual Property

Lawnnova, including its software, interface, branding, design, documentation, databases, schedule logic, product-rule structures, generated templates and content created by us, is owned by us or our licensors.

Except as allowed by these Terms, you must not copy, modify, distribute, sell, reverse engineer or create derivative works from Lawnnova.

Open-source components remain governed by their own licences.

16. Feedback

If you provide feedback, ideas, suggestions or improvement requests, you grant Lawnnova a perpetual, worldwide, royalty-free right to use them without compensation or obligation to you.

17. Third-Party Services And Links

Lawnnova may integrate with third-party services such as Supabase, OpenAI, Google Places, Open-Meteo, Sentry, app stores, payment processors and hosting providers.

Third-party services are governed by their own terms and policies. We are not responsible for third-party outages, errors, data quality, terms, pricing or conduct.

18. Availability And Changes

We aim to provide a reliable service, but Lawnnova may be interrupted, delayed, changed, suspended or discontinued.

We may add, remove, modify or limit features for operational, legal, safety, commercial or technical reasons.

19. Suspension And Termination

We may suspend or terminate your access if we reasonably believe you have breached these Terms, created risk, misused the service, failed to pay applicable fees or acted unlawfully.

You may stop using Lawnnova at any time. Account deletion, where available, is handled according to the Privacy Policy and app deletion workflow.

20. Privacy

Our handling of personal information is described in the Lawnnova Privacy Policy.

By using Lawnnova, you acknowledge that your information will be collected, used, stored and disclosed as described in the Privacy Policy.

21. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

Where permitted by law, our liability for breach of any non-excludable guarantee is limited to resupplying the services or paying the cost of resupplying the services.

22. Disclaimers

To the maximum extent permitted by law, Lawnnova is provided on an "as is" and "as available" basis.

We do not guarantee that:

• the service will be uninterrupted, secure or error-free;
• schedules, warnings, AI outputs, weather guidance or product information will be accurate or suitable;
• any lawn-care outcome will be achieved;
• defects will be corrected immediately;
• third-party services will remain available.

23. Limitation Of Liability

To the maximum extent permitted by law, Lawnnova and its officers, employees, contractors and suppliers are not liable for:

• indirect, incidental, special, consequential or exemplary loss;
• lost profits, lost revenue, lost data, business interruption or loss of opportunity;
• turf damage, plant damage, property damage, pest or disease outcomes, chemical misuse, injury or loss arising from product application;
• reliance on AI outputs, weather data, schedules, reminders, product guidance or third-party information;
• third-party service failures or app-store/payment-platform issues.

To the maximum extent permitted by law, our total aggregate liability for claims arising out of or relating to the service is limited to the amount you paid for Lawnnova in the 12 months before the event giving rise to the claim, or AUD $100 if you have not paid for the service.

24. Indemnity

To the maximum extent permitted by law, you agree to indemnify Lawnnova against losses, claims, damages, liabilities, costs and expenses arising from:

• your breach of these Terms;
• your misuse of the service;
• content you submit;
• your product application, treatment decisions or lawn-care activity;
• your breach of law or third-party rights.

25. Force Majeure

We are not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, outages, cyber incidents, government action, labour disputes, supplier failure, app-store disruption or telecommunications failure.

26. Changes To These Terms

We may update these Terms from time to time. The updated Terms will show a new "Last updated" date.

If changes are material, we will take reasonable steps to notify users where required. Continued use after changes take effect means you accept the updated Terms.

27. Governing Law

These Terms are governed by the laws of South Australia, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of South Australia and courts entitled to hear appeals from those courts.
